A proposed settlement has been reached in a class action lawsuit between Tubi, Inc. (“Tubi”) and an individual who used the Tubi video streaming service. The lawsuit alleges that Tubi violated a federal law called the Video Privacy Protection Act (“VPPA”) when it allegedly disclosed the “personally identifiable information” (as defined in the VPPA) of Tubi users in connection with advertising allegedly targeted at those users. The case is Gregory v. Tubi, Inc., Case No. 2024-LA-0000209, currently pending in the Circuit Court for the 17th Judicial Circuit, Winnebago County, Illinois.
The proposed Settlement is not an admission of wrongdoing by Tubi, and Tubi denies that it violated the law. The Court has not decided who is right or wrong. Rather, to avoid the time, expense, and uncertainty of litigation, the Parties have agreed to settle the lawsuit. The Settlement has been preliminarily approved by a court in Winnebago County, Illinois.
You may be included in the Settlement if you used the Tubi video streaming service at any time between June 23, 2021, and August 26, 2024.
If the Court approves the Settlement, members of the Settlement Class who submit valid claims will receive an equal, or pro rata, share of a $19,990,000 settlement fund that Tubi has agreed to establish. Each individual who submits a valid claim will receive an equal portion of this fund, after all notice and administration costs, a Class Representative service award, and Class Counsel’s attorneys’ fees and expenses have been paid. The amount that valid claimants will receive is unknown at this time and depends on certain unknown variables, including how many valid claim forms are submitted. You must submit a valid claim form to receive a payment from this Settlement.
